DELIVERY
The delivery times provided by Attacus Custom are estimates only. We will not be held accountable for late deliveries or damage relating to late deliveries.
In the event that multiple items are ordered, part deliveries may be made where stock is not available. Please ensure you enter the correct delivery address. Attacus Custom can not be held responsible for incorrectly entered delivery addresses. Attacus Custom is not responsible for items 'returned to sender' that are not received.
CUSTOMS, TAXES & DUTIES
Some international orders may incur a customs or import duty charge. These are not included in your order total. Our shipping charges cover transport only and will not include any extra import liabilities imposed. When a customer confirms an order they accept full responsibility for any customs charges incurred. Attacus Custom does not have any control over these charges and is unable to advise what they will be, as it is based on your own country’s regulations and compliances. Customers are advised to check with their local customs office before making a payment online.
INTELLECTUAL PROPERTY
When you submit your artwork and designs to Attacus Custom, you commit to us that: they don't infringe the intellectual property of any third party or any rights of publicity or privacy and that nothing in them violates any law, statute, ordinance or regulation.
You will indemnify Attacus Custom and at all times keep Attacus Custom fully and effectually indemnified against any and all claims, demands, actions, proceedings, costs, expenses (including legal costs and disbursements), liabilities, losses and damages suffered by Attacus Custom arising from or incurred by reason of any breach or alleged breach by you of this commitment.
All artwork designed by Attacus Custom employees on behalf of its customers is the intellectual property of Attacus Custom and is protected as a copyright work under the provisions of the Copyright Designs and Patents Act 1988. Customers are charged a Design Fee, which is a fee to licence the artwork from Attacus Custom for use on your Attacus Custom kit only. Any other replication or distribution of the artwork will be deemed as unlawful copyright infringement.
SHARING YOUR PERSONAL INFORMATION
For customers purchasing through our Attacus Custom store, please be aware that in some cases we will share your Order Information (as set out in our Privacy Policy) with the club/organisation/host of the products that you are ordering.
ORDER ACCEPTANCE
Attacus Custom reserves the right at any time after receipt of your order to decline that order for any reason. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item.
If we are unable to fulfill your order we will contact you as soon as possible, and your credit card/debit card or Paypal account will be refunded in the event that your order is not accepted.
RETURNS OF CUSTOM AND PRE-ORDERED GOODS
For custom-made items and items bought via a pre-order, each product will be made based on your specific order. We therefore cannot accept returns on these orders, unless:
a) You receive a different product to the one you ordered (the wrong size, for instance); or
b) The product is faulty
We will try to replace or repair custom or pre-ordered products that are faulty if you let us know about the fault within 14 days of your order being delivered to you. When your order is delivered, please check it carefully. After 14 days we can't guarantee to either repair or accept any returns of goods.
If you need to make a return on these basis, you can do so by emailing us on info@attacuscustom.com You'll need your order number and the email address linked to your order.
ERRORS AND OMISSIONS
In the case of errors or omissions on the website, Attacus Custom reserves the right to refund your order prior to the goods being despatched. Attacus Custom reserve the right to cancel any order if the product is no longer available. No compensation will be paid in such cases but customers will be notified and reimbursed for the full cost of the order. Every care has been taken to ensure that the descriptions and specifications of Attacus Custom's products are correct. The colours shown on the website are a close representation, but slight variations in the actual product colours may occur due to different screen resolutions and browsers.
